To put it simply, estate planning is the process of getting legal documents in place so you can choose who you would like to take care of you, your children, and your assets in the event of your death or incapacity. An “estate plan” is the collection of all of the documents needed to accomplish your wishes.
If you currently do not have a will or trust, you may think that you do not have an estate plan. However, you do! The state of New Jersey has written one out for you. All states have a default plan in the event of your incapacity or death. Estate planning is you “opting out” of this plan and documenting your goals and wishes.
Our process is designed to have your estate planning documents created and signed within 2-4 weeks of your Planning Session. It depends in part on your schedule and how long it takes you to review your draft documents, however you can rely on the work being done on our end to be completed as quickly and as efficiently as possible.
Estate planning is not a one size fits all. Once we know more about you, your situation, and your goals, we will have a better idea of what you need to accomplish your desires. We discuss fees and the process at length in the Planning Session, after we have thoroughly discussed all of your options. We do not discuss fees outside of the Planning Session.

This allows you to know exactly how much your investment in estate planning will be and that there will be no financial surprises. When you are ready to move forward please contact us. We will send you an Engagement Letter via Docusign and an invoice through a secure online payment provider. We will then schedule your Estate Plan Design Meeting where will design your estate plan and discuss your goals.
Probate is the court process of administering your estate upon your death. If you die with or without a will, your estate must go through probate court before all of your money can be given to your heirs. The only way to avoid probate is with a Revocable Living Trust. We will discuss this in detail at the Planning Session.
So, what’s so bad about the probate process? Why do people want to avoid it? Even a simple probate can take a lengthy amount of time, sometimes years, to complete with added expenses. Although a will is subject to the probate process, a living trust is designed to bypass it completely.
The simple answer is no! Estate planning is not correlated to how much money you have, your marital status, or whether or not you are a parent. Estate planning is putting together legal documents to ensure your documents will go to the people you want, the way you want in the event of your death. Estate planning is also about appointing people to manage your assets and make health care decisions for you if you are to become incapacitated. The estate plan will assist your loved ones during a difficult time, regardless of the amount of money you have.
A power of attorney lets you appoint someone to manage your property if you were to become incapacitated. You will name an “agent”, someone that you trust to manage your finances, business, etc. if you cannot. A healthcare proxy lets you appoint someone to manage your medical decisions should you be unable to do so. A living will allows you to make certain medical decisions regarding end-of-life decisions before the event occurs.
